Brightside Buckets Information
(Or, your Brightside Account Agreement, terms, and conditions)
Welcome to the Brightside Buckets information document which contains just about everything you need to know about your Buckets. We’ve tried to cover the most important things in this quick version section but we’ve included the longer, super legal version as well (exciting, we know!).
This guide will explain the most important information, but if you ever have questions, our customer support team would love to chat and is just a click away.
The quick version
- We promise to provide you with your Bucket and all of the services described in this Agreement. In return, you promise to be responsible for your Bucket, including any fees or expenses that apply as you use it.
- We take your privacy seriously. Any personal information we collect about you will be collected, used and disclosed in the way we tell you in “Your Personal Information” section below, and otherwise in the way we set out in our Privacy Statement.
- Always keep your Bucket card PIN safe by keeping it private (don’t share it with anyone, no matter how nicely they ask!)
- If you suspect fraudulent activity on your Bucket contact the Customer Success team immediately through the chat function in the Brightside app.
Legal definitions (start of the longer super legal version)
Brightside by ATB (Brightside) products and services are predominantly offered by ATB Financial to individuals resident in Alberta. Brightside products and services are not available to businesses. ATB Financial is an Alberta financial institution governed by the laws of the Province of Alberta and established and operating under the authority of the ATB Financial Act. The products and services of ATB Financial and/or its subsidiaries are only offered in jurisdictions where they may be lawfully offered for sale and are subject to applicable agreements. Brightside by ATB is a trademark of ATB Financial.
Before we get too far into things, here are the definitions you’ll need to know:
ABM: Automated bank machine, commonly called ATM.
Bucket: Your existing Brightside Buckets and any Brightside buckets you open with us in the future.
Agreement: This document — the thing you’re reading right now. The Agreement is between you and ATB Financial, and about your Bucket. This Agreement also applies to some pretty important stuff that you don’t normally think about, like your estate, your heirs, executors, administrators and your personal and legal representatives.
Item: A cheque, direct deposit, or other bill of exchange.
PIN or personal identification number: The 4−6 digit number that you enter for transactions using your Spend card. You first set your PIN when you get your Spend card and you can change it whenever you like (the more often the better, to combat fraud).
Spend card or card: Your Brightside card that you use to access a linked Bucket, make purchases, or withdraw cash. Any other means (e.g. purchases using Spend card information through a website or telephone) that you can use to incur charges on your Bucket will also be considered to be a Spend card.
We, our, us, and Brightside mean ATB Financial.
You/your: The person in whose name the Bucket was opened (the Bucket owner) and any other people on the Bucket, as indicated in our records.
About your Bucket
Important piece of information: Although ATB Financial provides Brightside services, you cannot access your Bucket or other services through any ATB branch.
Your responsibility: These are the current version of the terms and conditions you agreed to when you opened your Bucket, in exchange for us opening and maintaining your Bucket.
You promise to pay us any fees that you incur in using your Bucket, and to pay any other expenses that you’re responsible for. You’ll find more details about fees and some of the expenses you might have to pay, if applicable, at www.hibrightside.ca
Your Personal Information
We rely on the information you give us. You promise that all the information you provided on your application was true and accurate. You will let us know if any of your information changes. You agree that while you hold your Bucket, we may obtain information about you (including credit information) from credit reporting agencies and identity verification service providers to confirm your identity and ongoing credit worthiness.
Any personal information that we collect about you is collected, used and disclosed in accordance with the privacy statement which is available on our website or the Brightside mobile app.
We collect personal information about you to set up and maintain your Bucket, collect amounts owing to us, verify your identity, contact you, market to you if you provide consent, detect and prevent fraud and meet our legal obligations. To do this, we share personal information with service providers that we use to help us out and act on our behalf.
Brightside may share your personal information with third parties or agents within or outside of the Province of Alberta or Canada with whom we contract for the purposes of managing your relationship with us, and providing you the products or services you request. Personal information held with a third party or agent in another province or country is subject to the laws of that jurisdiction and thus may be collected, used, or disclosed without your knowledge or consent where required or permitted by law. Personal Information that we collect or disclose related to products and services offered through these other parties is managed carefully by contract and according to applicable privacy legislation and, where required, rules of regulatory authorities or self regulatory bodies.You can access our Out of Canada Service Providers Statement at https://www.atb.com/company/privacy-and-security/ for additional details of where we may store your personal information outside of Canada. If we notice some weird stuff going on with your Bucket—unusual, improper, suspicious or prohibited transactions—we’ll inform the government and law enforcement authorities about the activity. We may also share information with government or law enforcement if we are allowed to or have to by law.

Depositing your money
- You can deposit money into your Bucket anytime. Really, don’t hold back!
- If we’ve credited your Bucket with a deposit that is later dishonoured or returned (a bounced cheque, for example), we’ll then debit your Bucket for the amount of that deposit. You’ll also be responsible for any applicable fees and interest owed.
- If any of your Bucket details change — like you get a new Bucket number or you close your Bucket — make sure you notify anyone that is depositing money into your Bucket of those changes (like your employer or the Canada Revenue Agency). We aren’t responsible for letting them know, or for any charges or losses you might incur because you forgot to notify them.
- If any Item is deposited into your Bucket, you authorize us to endorse it on your behalf. We have no liability for endorsing any Item deposited.
You should know that we may refuse to accept a deposit for any reason. If we think there’s anything weird or suspicious happening with your Bucket or if we have to by law we can stop you from using the Bucket. We can also freeze or close the Bucket for any reason, including to avoid losses if you are a victim of fraud or identity theft.
Holds: Brightside might, at times, put a hold on the Items deposited to your Bucket as set out in its hold policy. Holds placed on Items, like a cheque, are meant to ensure the Item is not dishonoured or returned. Items may be returned unpaid for any reason, either during or after the expiry of the hold period, or after our release of the hold. You will be solely responsible for returned Items and we have the right to charge the amount of any return Item to the Bucket.
Note: If we place or release a hold on an Item (or if we don’t place a hold on it), that’s not our guarantee that it won’t later be dishonoured.
Accessing your money
We will let you know about the different ways that you can access your Bucket, including ways to identify yourself when using your Bucket. Right now, you can access your Bucket as follows:
- Use your Spend card at any ABM or store that has a debit or credit machine with one of the symbols on the back of your card.
- Log in to the Brightside mobile app.
- Log in to app.hibrightside.ca
- Use our funds transfer service. You may make a funds transfer to another bucket at Brightside or to another Canadian financial institution. Upon your verification of the details of the transfer, Brightside will immediately withdraw the funds from the Bucket you designate. We will send the funds for transfer by the end of that business day if the instructions are received by us during the business day, or by the end of the next business day if we receive the instructions outside of business hours. You agree that we are not responsible for any loss or costs you may suffer as a result of any errors in the bucket or other transfer details that you provide us. You acknowledge that we cannot control when another financial institution will credit the bucket of the person to be receiving the funds. You acknowledge that Brightside cannot cancel any transfer of funds once the transfer has been sent. If the bucket details that you provide us are invalid, then the transfer amount will be returned and deposited into your Bucket or any other bucket you have with us.
- Your Brightside Bucket balance is in Canadian dollars but you can use your Card for a transaction in a different currency (a “Foreign Currency”). If you use your Card for a transaction in a currency other than Canadian dollars, the Foreign Currency transaction will be converted into Canadian dollars before it is posted on your Brightside Bucket. The amount of your transaction will be converted to Canadian dollars at the conversion rate established by MasterCard International Inc. (“MCI”). For purchases and cash advances, that rate is set at the time the transaction is presented for payment to MCI. For credits to the Brightside Bucket, that rate is set at the time the credit is presented for payment to us from MCI. When the transaction is posted to your Brightside Bucket, in addition to the conversion rate, you will be charged the foreign currency conversion fee noted in the Fee Table above on the transaction amount. That foreign currency conversion fee will be added to the amount of the foreign currency transaction after the foreign currency has been converted to Canadian dollars. For any reversals of these Foreign Currency transactions, the exchange rate will be determined in the same manner described above on the date the transaction is reversed.
- Any other way we may have available for you, now or in the future.
All the various ways that you access your Bucket may be subject to other terms and conditions, such as when you set up a pre-authorized debit with a third party. Those would be separate from this Agreement, and this Agreement would continue to apply to your Bucket, as well.
Spend Card: We’ll give you a Spend card with a PIN that you can use to access the money in your Bucket. The Spend card is our property and we can ask you to return it to us at any time, or we can replace it at any time. So, it’s more like we loan you a card—but you can use it like it’s yours.
Transactions (aka buying stuff): You can use your Spend card to withdraw cash at ABMs, to make purchases at stores, and to get cash back at stores that offer it. You’ll have to enter your PIN to use your Spend card for withdrawals and purchases, unless we let you know that your Spend card can also be used at “tap and go” or contactless payment terminals. To pay for goods and services wherever your card is accepted as a form of payment, including (i) in person, by presenting the Card to a merchant at a point of sale (POS) terminal or in a store; or (ii) without physical presentation of the Card to a merchant (such as, by mail order, online, over the telephone or any other electronic means).
You should always keep your PIN safe, because you’re responsible for any transactions made on your Spend card using your PIN or tap. If we notice that your Spend card has been compromised, or if you report your Spend card lost or stolen, we’ll place a hold on your Bucket and arrange to get you a new Spend card. If this happens, you’ll need to choose a new PIN.
Keeping your PIN safe: Change your PIN. Change it often, say, every month. Changing your PIN makes it harder for those who fiddle with debit or credit machines to get access to your Bucket. They hate it when you outsmart them like that! And while you’re thinking of ways to stop fraudsters from getting at your money, here’s some more good advice:
- Don’t make your PIN easy to guess, like your birthday or your home address or combinations that are easy to remember, like 1-2-3-4 or 7-7-7-7.
- Cover the keypad when punching in your PIN. Don’t worry about offending the people standing near you—they don’t care.
- Don’t give your PIN or Spend card number to anyone. Not your mom. Not your significant other. No one.
- Don’t write your PIN on your Spend card. Really. Just don’t do this. Ever.
- When you’re using your Spend card to make a purchase, don’t let it out of your sight.
- If you think a pay terminal or ABM has been altered, call the police. If it looks sketchy, it probably is.
- Put a monthly reminder to change your PIN in your calendar.
- You can change your PIN in the Brightside mobile app. Sound like a hassle? Not compared to trying to undo the damage if someone manages to get your Spend card and your money.
Lost or stolen card or PIN: Contact us as soon as you notice that your Spend card is lost or stolen, or if you suspect someone else may be using your Spend card or may know your PIN. Trust us, it’s worth your time to stop fraud before it happens. You’re not responsible for any transactions that occur after you tell us about the loss or theft. And assuming you’ve followed our “keep your PIN safe” protocol, we’ll reimburse you for any amount that has been taken from your Bucket without your authorization.
Your liability: Okay, this is important stuff. You’re responsible for the full amount of entered and completed transactions on your Bucket, and for any fees and expenses that you incur on your Bucket, even if you or someone you authorize made an error. You’re also responsible if you or someone you authorize is fraudulent in entering information when a transaction is conducted, or if you don’t notify us as soon as you become aware that your Spend card is lost, stolen or misused, or your PIN may have become known by someone else. In any of these situations, your liability could exceed the credit balance or available funds in the Bucket, so we may have to create an overdraft on the Bucket. You’ll then be responsible for the amount of the transaction, plus any applicable fees and any interest. You’re also responsible for any fraudulent or worthless deposits that have no real value.
You’re not liable when you report your card as lost or stolen, or in confirmed cases of fraud, when the information contained on your Spend card is stolen and used to take funds from your Bucket that you didn’t authorize.
Limits: Typically, we set two different types of limits on your Bucket when you open it: one limit on how much money you can take out at an ABM at any one time and throughout the day, and another a limit on how much you can spend throughout the day using your Spend card at stores or businesses. These limits are in place to protect you from losses should the Spend card be compromised, lost or stolen. We may let some purchases go through your Bucket that are over your set limits, and generally, we only reduce limits—or change limits without letting you know—when we suspect fraud (although we reserve the right to do so for other reasons). If you have any questions about your limits, let us know through the Brightside mobile app or call us, we’re happy to chat. We’re also happy to work with you to set a limit that makes sense for your needs.
Problems with merchants: If you have a problem with something you bought with your
Spend card, unfortunately, we can’t help you fix the problem. We’re also not responsible for the problem, either. You have to resolve the problem directly with the merchant involved in the transaction. You’re always welcome to give us a shout and ask if we know how to fix the issue—we’re wizards with broken coffee makers! No guarantees, but we’re always happy to try and help if we can.
Protection for those “just in case” moments: Overdrafts without overdraft protection: No, that’s not a typo. Even if you don’t have overdraft protection on a Bucket, we may still permit an overdraft to occur on your Bucket. If you happen to go into overdraft without prior arrangements, then you’ll have to repay the overdrawn amount immediately, and we’ll charge you our current overdraft fee (for overdrafts without overdraft protection) as well as interest at the overdraft interest rate.
Stop payments: Contact us if you need to stop a payment, such as a direct debit that is no longer authorized. That being said, there are some payments that we can’t stop, such as a payment that’s already cleared your Bucket, when a pre-authorized payment is set up with a third party, or when we don’t have sufficient time to stop that payment for you. That’s why it’s important to contact us as soon as possible and with the exact details about the payment you’re trying to stop.
Just so you know, we are not responsible for any losses that you might incur if we are not able to process a stop payment request in time.
Giving us instructions: We’ll act on any instructions, in any form, that we think are from you, but we may decline or refuse any instructions, including not allowing you to access your Bucket—even if they appear to be from you— if we think they’re improper, unlawful, unauthorized or fraudulent, or that there is a mistake. It’s part of our commitment to keep you and your money safe.
You need to know this: We are not be responsible for any loss you may incur because we acted on instructions that we thought were genuine, or because we didn’t act on instructions that we thought were improper, unlawful, fraudulent or mistaken.
Estates and Deceased Buckets: In the unfortunate event that you pass away, it is crucial that we connect with your estate representative or next of kin. We suggest you consider letting them know you have buckets with us and how they can get in touch with us.
Fees and interest
Fees: All fees are charged in CAD$ and are subject to change from time to time. If you owe us or any of our affiliates any amount for any reason, then you agree that we can deduct amounts from one or more of your buckets to repay some or all of that debt or liability. We’ll also deduct, from any of your buckets, any amount that we have paid you or credited to one of your buckets, if we determine that an Item is in any way fraudulent or has an endorsement error, or if we determine that we may incur a loss if the payment or credit is not reversed. In any of those cases, we’ll also charge for all of the costs that we incur. In deducting any of these amounts from your Bucket, you acknowledge that we may create an overdraft in your Bucket. We can do this even though someone else (a third party) may demand payment and even though we have other rights at law or in equity.
Interest: Some of our buckets may pay interest. If interest applies to your Bucket, we’ll tell you what the interest rate is when you open the Bucket. Interest is calculated daily and paid to the Bucket monthly. You should know (and keep in mind that), interest rates vary and may change from time to time (and could even be reduced to zero per cent). If we told you that interest applies to your Bucket, then we’ll make sure to also tell you if the interest rate changes (or if we change the way that interest is calculated) by posting the new rate and any interest calculation changes in at www.hibrightside.ca.
Keep track of your money
Paperless statements: Ready to save a tree? Sick of the clutter that comes with too much paper? The good news is all our statements are available digitally in the form of transaction lists. No more messy kitchen drawers or piles of paper lying around.
The really really legal stuff
Amendments: We can change any of the terms of this Agreement at any time. If we have to by law then we’ll tell you about the change before we make it. Even if we don’t have to, we’ll still tell you about the change but we may tell you about it after the change is made instead. If you conduct any transaction on your Bucket after we have made a change to this Agreement , that will mean that you agree to the change. You can get the most up-to-date version of this Agreement at any time at support.hibrightside.ca.
Processing Items: You waive presentment, protest and notice of dishonour on every Item that we receive in any way for deposit or acceptance on your Bucket. This means that you waive certain formal legal requirements to make it easier for us to process any Item that we receive for your Bucket. You’ll be liable to us for any Item received for your Bucket as if it was presented, protested and given notice of dishonour in the usual way.
ATB Financial, in its discretion, may note or protest any such Item for any reason at your expense. ATB Financial will not, however, be liable to you for any failure or omission to note or protest any such Item. Even if your Bucket has been closed, you should remember that you will still be responsible for Items we received for deposit or acceptance on your Bucket that haven’t been processed. (Whew. Sorry, that was a bit convoluted. And yes, we had to read it twice, too.)
Notices and other communications: You will receive notices and other communications by electronic methods and agree that this information will be considered to be received by you on the date we sent it. You should also know that our records about when we sent any information to you can be used as evidence in court and in any other legal proceeding as if these records were original documents. If you want to receive the notices in any other form it is your responsibility to notify us. If you need to make a change to your address or notice choice, you can do so in the Brightside mobile app.
Inactive Buckets and unclaimed balances: When there hasn’t been any activity (withdrawal, deposit or transactions initiated by you) on yourBucket for a year, it’s considered inactive and we’ll notify you if this happens by sending the notice to the address we have for you in our records. When your Bucket is inactive, you may have limited access to the funds in your Bucket. And according to the Alberta Treasury Branches Regulation, balances that are designated as unclaimed (which is after two years of inactivity) and not claimed within 10 years of the date that the Bucket is designated as unclaimed will, depending on the unclaimed amount, either be paid to the Province of Alberta or retained by us. If that happens, you’ll still be able to claim your money from us (we’ll just need to see proof of your identity), or from Alberta Treasury Board and Finance, Tax and Revenue Administration if we’ve transferred it.
- For Buckets with balances under $250 (Canadian or equivalent), we’ll keep the funds if they’re not claimed within 12 years from the date of the last transaction on your Bucket.
- For Buckets with balances of $250 or greater (Canadian or equivalent), the money will be sent to the Alberta Treasury Board and Finance, Tax and Revenue Administration if it hasn’t been claimed within 10 years of the date the Bucket is designated as unclaimed.
If your Bucket becomes inactive, we’ll make sure to notify you at specific intervals to remind you what will happen with the money if you don’t claim it, and we may charge a fee to send out those notices. If a fee applies, it will be deducted from your Bucket but if you don’t have enough money in the Bucket to cover the applicable fee, then we’ll close your Bucket without telling you first.
Severability: If a Court determines that any section or sections of this Agreement are not enforceable, we’ll treat that section or sections as if they weren’t in the Agreement, and the rest of this Agreement will still remain in effect and unaffected by the removal of the unenforceable sections.
Disputes: If there is a dispute over funds in your Bucket or in relation to any instructions given on your Bucket, then we have the right to pay the money into Court and recover from you any expenses—including legal costs—that we incur. We also have the right to freeze the Bucket or freeze any of the funds in the Bucket in the event of a dispute, or if we need to determine the ownership of the funds. We will not unnecessarily restrict the use of funds that are the subject of the dispute.
Verifying your Bucket: It’s your responsibility to review your Bucket activity at least once a month. You can do this by accessing Brightside and verifying the transactions on your bucket. If you find an error or something seems wrong, let us know so we can look into it for you. If you find an error and wish to dispute it, you must notify us within 60 days of the date a transaction or Item was either posted to your Bucket or missed. If you don’t notify us within that time period, then you agree that your Bucket transactions and balances are conclusively
accurate, regardless of whether you actually received your statement or otherwise reviewed the
activity on your Bucket. This means that unless you tell us otherwise, we’re assuming everything is A-OK. Despite this, we may still debit your Bucket for any amount that was credited in error or returned to us or dishonoured.
Law that applies: This Agreement is governed by the laws of the Province of Alberta and the
laws of Canada that apply in Alberta, and you agree to submit to the jurisdiction of the courts of the Province of Alberta.
Ending this Agreement: Either of us (you or Brightside) can end this Agreement by notifying the other of our desire to do so. Unlike a break-up by text, we’ll give you a reasonable amount of time before ending the Agreement. No matter who ends the Agreement and for what reason, you’re still responsible for any outstanding amounts owed to us and you’ll still be responsible for all of your obligations under this Agreement until all amounts owing, including fees and other costs, are paid in full. We may deduct any amounts you owe from any of your buckets with Brightside. If at the time of closure the Bucket has a positive balance, we will deliver a cheque for the balance to you (minus any amounts we deduct for amounts you owe to us) at your last known address, as shown in our records (unless you and we agree to a different method of payment). Thereafter we shall be completely relieved of our obligations and liabilities to you under this Agreement.
Assignment: This Agreement is binding on you, your heirs, executors, administrators and other legal representatives, successors and assigns. We may assign our rights and obligations under this Agreement at any time, without notice to you. You may not assign your rights or obligations under this Agreement.
Limitation of liability: Under no circumstances will we be liable to you for any indirect, special, consequential, exemplary or punitive damages or losses in connection with your Bucket or in relation to any service that we provide to you, and whether or not your claim is made under this Agreement or otherwise. This will apply even if we knew such damage or loss was possible or even likely to occur, and even if it was caused by our negligence. There is no way we’ll be liable to you for any revenue or profits you might lose. We’ll also not be liable to you for other damages or losses, unless caused by our negligence, including damages or losses you incur because we acted on your instructions, or on instructions that appeared to be from you, or because we didn’t act on your instructions because we thought they were improper, unlawful, fraudulent or mistaken, or for any reason beyond our control. If we suffer any damages or losses because we carried out your instructions on your Bucket, you agree to pay us for the amount of those damages or losses.
Reserving our rights and not waiving our rights: We reserve any rights that we may have under the law and we do not accept any liability that we have not expressly agreed to assume in this Agreement or under the law. If we waive any of our rights under this Agreement or at law at any particular time, it doesn’t mean that we’re waiving those rights for any future situation, whether similar or not.
Outstanding debts and legal costs: In any situation where we’re enforcing the terms and conditions of this Agreement, if we incur legal costs in doing so, then you’ll be obligated to pay us for those legal costs. We may deduct the legal costs from any of your buckets or we may require you to pay us directly.
Service of documents and demands for information: If we receive any lawful demand related to your Bucket, whether for money from your Bucket or for information in relation to you or your Bucket, then we’ll comply with that demand. We’ll deduct from your Bucket any costs that we incur in complying with the demand.

General: ATB Financial is incorporated under the laws of the Province of Alberta, and deposits with ATB Financial are 100% guaranteed by the Province of Alberta.
